租客向業主提出終止租約,業主和租客需要做什麼手續? 請問死約、生約分別有甚麼法律效力?是否於死約期滿後可提出解除租約?

如果雙方都同意就在租約正本, 新加段提早終止租約條款後加簽, 再找個見證人簽名, 就可以了
死約=期間業主租客都受約束不能退租. 如要解約,要賠租金直至死約滿為止
生約=期間業主不能退租, 租客可以退租, 但要給業主最少一個月通知

from 9th July, 2004 the law of tenancy have not 生約, two parties need to signing surrender agreement for termination of the tenancy. the tenancy only have 1 yr fixed tenancy or 2 yrs fixed tenancy.
舊例有生約只是一個續租權, 任何一方如果想終止租約, 必須在租約完結前一個月通知另一方或根據租約內條文
