Separation Deed
When a couple decides to separate with a view to apply for divorce,it is advisable to sign a separation deed in advance to set out the terms of settlement on children¡¦s custody and monetary matters i.e. the disposal of joint name property, maintenance during separation period and after divorce is granted by the court.

To apply for divorce, one has to tell and satisfy the court the reason. Under the family law in Hong Kong, there are only five reasons which one can apply for divorce.
(1) The spouse committed adultery;
(2) The spouse has behaved in such a way that the petitioner cannot reasonably be expected to livewith;
(3) One year separation has lapsed and the spouse to the divorce;
(4) Two year separation has lapsed without the need of the consent from the spouse;and
(5) The spouse has deserted for a continuous period of at least 1 year.
 
One may apply for a declaration from the court that the marriage was null and void.
